fa نقش اخلاق در مسئولیت مدنی ناشی از هوش مصنوعی The Role of Ethics in Civil Liability Due to Artificial Intelligence تخصصي Special مروری Review Article <div style="text-align: justify;">زمینه: پیشرفتهای چشمگیر در فناوری هوش مصنوعی، نظام های حقوقی سنتی را با چالش های نوظهوری در حوزه مسئولیت مدنی مواجه کرده است. ویژگیهایی مانند یادگیری ماشینی، تصمیمگیری خودمختار، و فقدان دخالت مستقیم انسانی در عملکرد سامانه های هوشمند، انتساب تقصیر و تشخیص مباشر یا مسبب را دشوار ساخته اند. از این رو پژوهش حاضر با هدف بررسی نقش اخلاق در مسئولیت مدنی ناشی از هوش مصنوعی شکل گرفت . نتیجه گیری: در حقوق ایران، چارچوب های موجود نظیر مواد ۱، ۳۲۸ و ۳۳۱ قانون مدنی و قواعد فقهی از جمله «من اتلف» و «لاضرر»، توان پوشش دهی کامل به این تحولات فناورانه را ندارند و قانون گذاری خاصی در این حوزه صورت نگرفته است. بااین‌حال، باید مسائل اخلاقی هوش مصنوعی در فضای رقومی به‌منظور جلوگیری از سوءاستفاده شناسایی شود و مورد توجه قرار گیرد. ازاین‌رو باید اصول اخلاقی در سامانه مبتنی بر هوش مصنوعی در نظر گرفته شود و دستورالعمل‌هایی برای کاربرانی که فناوری‌های هوش مصنوعی را اجرا می‌کنند، ارائه شود که از آن می‌توان به‌عنوان اخلاق رقومی نام برد.از این رو، انتخاب سازو کار مشخص مسنوولیت مدنی برای هوش مصنوعی به لحاظ اجتماعی و اقتصادی حائز اهمیت است. قوانین ملی رویکردهای متفاوتی برای سازگاری با چالشهای هوش مصنوعی دارند. در خصوص مبنای مسوولیت هوش مصنوعی، به طور کلی در اغلب مقررات کشورهای اروپایی مسوولیت مبتنی بر تقصیر به مثابه اصل پیش بینی شده است.</div> <div style="text-align: justify;">Background: Significant advances in artificial intelligence technology have confronted traditional legal systems with emerging challenges in the field of civil liability. Features such as machine learning, autonomous decision-making, and the lack of direct human intervention in the operation of intelligent systems have made it difficult to attribute fault and identify the perpetrator or the perpetrator. Therefore, the present study was formed with the aim of investigating the role of ethics in civil liability due to artificial intelligence. Conclusion: In Iranian law, existing frameworks such as Articles 1, 328, and 331 of the Civil Code and jurisprudential rules such as “I will not harm” and “no harm” are not able to fully cover these technological developments, and no specific legislation has been enacted in this area. However, the ethical issues of artificial intelligence in the digital space must be identified and addressed in order to prevent misuse. Therefore, ethical principles must be considered in the AI-based system and guidelines must be provided for users who implement AI technologies, which can be referred to as digital ethics. Therefore, choosing a specific civil liability mechanism for AI is socially and economically important. National laws have different approaches to adapting to the challenges of AI.
