fa نقش اخلاق در تعیین شدت مجازات تخصصي Special مروری Review Article <span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span lang="AR-SA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">زمینه: </span></span></b><span lang="AR-SA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">وقوع رفتارهای مغایر با عفت و اخلاق عمومی در هر اجتماع امری مسلم و انکار ناپذیر است. آنچه در این میان مهم می نماید، نوع واکنش اتخاذ شده از سوی حکومت در قبال رفتارهای نامبرده است. راهبرد انتخاب شده از سوی برخی جوامع از جرم انگاری آنها در چهار چوب حقوق کیفری حکایت دارد. تعیین‌ مجازات و اتخاذ قوانین‌ کیفری‌ با شیوه ها و رویکردهای‌ مختلفی‌ همراه می باشد و با توجه‌ به‌ برجسته‌شدن نقش‌ اخلاق در قوانین‌ کیفری‌ اجتماع گرایانه‌ و انسان محورانه‌، نقش‌ اصول اخلاقی‌ در تعیین‌ مجازات از اهمیت برخوردار است‌. از این رو مطالعه حاضر با هدف بررسی نقش اخلاق در تعیین شدت مجازات شکل گرفت.</span></span></span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span lang="AR-SA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">نتیجه گیری:</span></span></b><span lang="AR-SA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;"> اعمال اصول اخلاقی‌ بر مبنای‌ توجه‌ به‌ رویکردهای‌ حبس‌زدایانه‌، بازپروری‌ و اصلاح مجرمان، روش های‌ جایگزین‌ مجازات و همچنین‌ دفاع از روش های‌ تأمینی‌ و تربیتی‌، کمک‌ شایانی‌ به‌ مجرمین‌، نهاد خانواده و افرادی‌ که‌ به‌اَشکال مختلف‌ با مجرمان و بزهکاران در ارتباط هستند، می‌کند. قانون مجازات اسلامی‌ نیز رویکرد اخلاقی‌ را بر مبنای‌ زندان&shy;زدایی‌ و کمک‌ به‌ مجرمان و بزهکاران در جرائم‌ غیرعمد در نظر گرفته‌ است‌. از این رو، گذر از رویکرد عدالت‌ سنتی‌ و حرکت‌ به‌ سمت‌ الگوهای‌ انسانی‌ و اخلاقی‌، کمک‌ به‌ مجرمان غیرعمد و جرائم‌ کوچک‌، ترویج‌ روش های‌ جدید جایگزین‌ مجازات و همچنین‌ توجه‌ به‌ مشارکت‌ مردم در ساماندهی‌ امور قضایی‌، جلوه های‌ مداخله‌ اخلاق در تعیین‌ مجازات و قوانین‌ کیفری‌ هستند که‌ امروزه نیازمند توجه‌ بیشتری‌ می‌باشند.</span></span></span></span></span></span></span><br> &nbsp; <div style="text-align: justify;"><span style="font-family:Times New Roman;"><span style="font-size:11pt"><span style="line-height:normal"><b><span style="font-size:12.0pt">Background</span></b><span style="font-size:12.0pt">: The occurrence of behaviors contrary to public morality and decency in every society is a certain and undeniable fact. What is important in this regard is the type of reaction adopted by the government towards the aforementioned behaviors. The strategy chosen by some societies indicates their criminalization within the framework of criminal law. Determining punishment and adopting criminal laws are accompanied by various methods and approaches, and given the prominent role of ethics in socialistic and human-centered criminal laws, the role of ethical principles in determining punishment is important. Therefore, the present study was formed with the aim of investigating the role of ethics in determining the severity of punishment.</span></span></span><br> <span style="font-size:11pt"><span style="line-height:normal"><b><span style="font-size:12.0pt">Conclusion</span></b><span style="font-size:12.0pt">: Applying ethical principles based on attention to approaches to release from prison, rehabilitation and correction of criminals, alternative methods of punishment, as well as defending security and educational methods, provides significant assistance to criminals, the family institution, and individuals who are in various ways related to criminals and delinquents. The Islamic Penal Code has also considered an ethical approach based on de-prisonment and assistance to criminals and delinquents in unintentional crimes.
