other بنیان های اخلاقی جرم‌انگاری پدیده کودک همسری Moral Foundations of Criminalizing the Phenomenon of Child Marriage تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: پدیده کودک همسری به عنوان آسیب اخلاقی  و تهدید کننده سلامت جسمی و روحی کودکان است که در این میان دختران بیشترین سهم زیان  و آسیب را متحمل می‌شوند. ازدواج کودکان غیراخلاقی است زیرا در این سن کودک از نظر روانی، عاطفی، اقتصادی و جسمی آمادگی ازدواج را ندارد بنابراین کودک همسری به عنوان یک آسیب اخلاقی حقوق اولیه افراد را نادیده می گیرد. با توجه به اهمیت این امر پژوهش حاضر با هدف بررسی بنیان های اخلاقی جرم&rlm;انگاری پدیده کودک همسری شکل گرفت. نتیجه گیری: نتایج این تحقیق حاکی از آن است کودک همسری نقض اصول اخلاقی است و از این رو در حقوق به عنوان یک موضوع مجرمانه مورد بررسی قرار می گیرد. بنابر اسناد بین المللـی موجـود، ازدواج کودکـان یکـی ازاشـکال ازدواج اجبـاری ومصداق نقض حقوق بشر می باشد عوامل متعددی در بروز کودک همسری دخیل بوده که فقـر دلیـل اصـلی ایـن پدیده است. بنابراین ازدواج زودرس پیامدها وآثارمنفی بسـیاری ازخـود بـه جـامی گـذارد کـه در زوال سـه حـق تأتیرگذار است: حق آموزش، حـق بهداشـت، حـق انتخـاب، بنابراین کشورها و جوامع بین المللی با تدوین مجموعه قوانین باید در جهت حل این معضل گام بردارند و مهم دستاورد آن تبیین فرایند و چگونگی جرم انگاری این پدیده در این عرصه می باشد. </div> <div style="text-align: justify;">Background: The phenomenon of child marriage is a moral harm and a threat to children's physical and mental health, among which girls bear the largest share of losses and damages. Child marriage is immoral because at this age the child is not mentally, emotionally, economically and physically ready for marriage, so child marriage as a moral harm ignores the basic rights of people. Considering the importance of this matter, the present study was formed with the aim of investigating the moral foundations of criminalizing the phenomenon of child marriage.  Conclusion: The results of this research indicate that having a child in marriage is a violation of moral principles and therefore it is considered as a criminal matter in law. According to existing international documents, child marriage is one of the forms of forced marriage and an example of violation of human rights. Several factors are involved in the occurrence of child marriage, and poverty is the main reason for this phenomenon. Therefore, early marriage has a lot of consequences and negative effects, which leads to the deterioration of three rights: the right to education, the right to health, and the right to choose. Therefore, countries and international communities should take steps to solve this problem by compiling a set of laws and explain the important achievement of it.
