fa بررسی اصول اخلاقی حاکم بر دادرسی عادلانه Examining the Ethical Principles Governing Fair Proceedings تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: رابطه بین اخلاق و حقوق امری مسلم و مورد تایید و تاکید فلاسفه و اندیشمندان اخلاقی و حقوقدانان است. دادرسی عادلانه و منصفانه، یکی از بنیادی ترین مطالبات اخلاقی در نظام حقوقی است و پایبندی به اصول اخلاقی در مراحل دادرسی از جمله نیازهایی است که امروزه در دادرسی‌ها خاصه در مراجع شبه‌ قضایی کیفری ملموس است. از این رو، مطالعه حاضر با هدف یررسی اصول اخلاقی حاکم بر دادرسی عادلانه در نظام حقوقی ایران شکل گرفت. نتیجه گیری: عینیت یافتن عدالت نیازمند قانون و قاعده است. دولتها به شیوه های مختلف از جمله قانونگذاری و پیش بینی مکانیزم اجرایی موثر، به تضمین حق دادرسی عادلانه برای افراد متعهد هستند. متعالیترین و موکدترین تعبیرها در این زمینه در تعالیم و آموزه های دین مبین اسلام یافت می شود. اسلام همواره فریاد برپایی قسط و عدل، احقاق حقوق مظلوم، استقرار صلح و آرامش و داوری و قضاوت عالانه را سر داده است. نظام جمهوری اسلامی ایران نیز با تاسی از دین مبین اسلام در صدد تضمین دادرسی عادلانه است. دادرسی عادلانه شامل مصادیق متعددی است که هر فردی در فرآیند دادرسی اعم از کیفری و مدنی از آن برخوردار است. مصادیق دادرسی عادلانه عبارتند از: حق دادخواهی، دسترسی به دادگاههای بیطرف و مستقل ، برابری امکانات دفاع، اصل تقابل یا تناظر، حق رسیدگی حضوری و علنی،حق تجدیدنظر خواهی و حق رسیدگی در مهلت معقول . </div> <div style="text-align: justify;">Background: The relationship between ethics and law is certain and confirmed and emphasized by philosophers, moral thinkers and lawyers. A just and fair trial is one of the most fundamental ethical demands in the legal system, and adherence to ethical principles in the trial stages is one of the needs that is tangible in proceedings today, especially in criminal quasi-judicial authorities. Therefore, the present study was formed with the aim of investigating the ethical principles governing fair proceedings in Iran's legal system. Conclusion: Finding the objectivity of justice requires law and rule. Governments are committed to ensuring the right to a fair trial for people in various ways, including legislation and the provision of an effective enforcement mechanism. The most sublime and thorough interpretations in this field can be found in the teachings of the religion of Islam. Islam has always called for the establishment of justice and justice, the rights of the oppressed, the establishment of peace and tranquility, and public judgment. The system of the Islamic Republic of Iran also seeks to ensure a fair trial with the support of the religion of Islam. Fair trial includes many examples that every person has in the process of both criminal and civil proceedings.
