other اخلاق در نظام حقوقی: دادرسی عادلانه در هیأت های شبه قضایی ثبتی Ethics in the Legal System: A Fair Trial in Registered Quasi-Judicial Bodies تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: دادرسی عادلانه و منصفانه، به عنوان یکی از بنیادی ترین مطالبات اخلاقی در نظام حقوقی می&lrm;تواند پیامدهای مثبتی را در نظام حقوقی برجای گذارد. تأثیرگذاری نظام ثبتی در جامعه درحال افزایش می&lrm;باشد و لازم است تا پیمایش های مناسبی درباره رعایت انتظارات از آنها به ویژه در زمینه توجه به قواعد ماهوی دادرسی منصفانه انجام شود. در قوانین و مقررات ثبتی به صراحت نسبت به دادرسی عادلانه اشاره ای نگردیده است و نظام دوگانه ای قابل تصور است. نخست، در برخی از این اصول گزاره هایی در راستای رعایت آن در هیأت های شبه قضایی ثبتی دیده می شود. دوم، وجود کاستیهایی که کفه ترازو را به آن سمت سوق می&lrm;دهد و در مجموع اینکه توجه کافی و شایسته&lrm;ای به جایگاه و اهمیت اصول دادرسی منصفانه در روند شکل دهی هیأت های شبه قضایی ثبتی مشاهده نمی شود. این مقاله، ضمن بررسی هیأتهای شبه قضایی ثبتی نشان می&lrm;دهد که دادرسی عادلانه یکی از شاخه های دادرسی اخلاقی و مطلوب بوده که به رغم اهمیت بالای آن در قوانین و مقررات ثبتی کمتر بدان پرداخته شده است. نتیجه گیری: یافته های این پژوهش نشان می دهد  تسری تضمینات دادرسی عادلانه و منصفانه در این هیأتها به نحو کامل و در تمام مراحل رسیدگی ممکن نیست که این امر منجر به تضییع حقوق اشخاص می&lrm;گردد. شایسته است فرایند مطلوبی در بازنگری قوانین و مقررات ثبتی وبازتاب قواعد دادرسی منصفانه و تعیین ضمانت اجرایی اندیشیده شود تا از این طریق امکان منصفانه سازی دادرسی هیأتهای فوق افزایش یابد و بنیان های اخلاقی نظام حقوقی دچار تزلزل نگردد. </div> <div style="text-align: justify;"> Background: A fair and just trial, as one of the most fundamental moral demands in the legal system, can have positive consequences in the legal system. The effectiveness of the registration system in society is increasing and it is necessary to conduct appropriate surveys to meet their expectations, especially in terms of paying attention to the substantive rules of fair trial. The rules and regulations of registration do not explicitly mention a fair trial, and a dual system is conceivable. First, in some of these principles, statements are made in order to comply with it in registered quasi-judicial bodies. Second, the existence of shortcomings that lead the scales in that direction, and in general, that sufficient and worthy attention is not paid to the position and importance of the principles of fair trial in the process of forming quasi-judicial bodies. This article, while examining the quasi-judicial bodies, shows that a fair trial is one of the branches of ethical and desirable proceedings, which, despite its high importance in registration laws and regulations, has received less attention. Conclusion: The findings of this study show that it is not possible to fully extend the guarantees of a fair and just trial in these panels and in all stages of the proceedings, which leads to the violation of the rights of individuals.
