fa ملاحظات اخلاقی در مبارزه با مجرمان یقه سفید و نگاهی به قانون چای دبش در ایران تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span lang="AR-SA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">زمینه: </span></span></b><span lang="FA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">در سالهای اخیر، رخدادهای مبتنی بر فساد و اختلاس مانند آنچه در شرکت چای دبش رخ داد بدنه اقتصادی کشور را بیش از پیش تضعیف کرده است. وقوع چنین فسادهای مالی، امنیت روانی جامعه را بر هم می&shy;ریزد؛ چیزی که زیاد به آن توجه نمی&shy;شود. افرادی که باعث وقوع چنین فسادهای مالی با مبلغ بسیار زیادی در جامعه می&shy;شوند، قطعاً و یقیناً از افراد عادی جامعه نیستند و مجرمان یقه سفید هستند. در مطالعه حاضر مبارزه با مجرمان یقه سفید در ایران مورد بررسی قرار می گیرد و ملاحظات اخلاقی در این زمینه مطرح می شود. </span></span></span></span></span></span></span><br> <b><span dir="RTL" lang="FA" style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">نتیجه گیری:</span></span></span></b><span dir="RTL" lang="FA" style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;"> در حالت کلی جرایمی مالی که مجرمان یقه سفید در ایران مرتکب می&shy;شوند را می&shy;توان با کوه یخ سرگردان در اقیانوس مقایسه کرد که فقط بخشی از آن نمایان و حجم وسیعی از آن پنهان است. &nbsp;ملاحظات اخلاقی برای رسیدگی به جرایم یقه سفید ضروری است</span></span></span><span style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;Arial&quot;,sans-serif">. </span></span></span><span dir="RTL" lang="FA" style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">سازمان ها و متخصصان حقوقی باید استانداردهای اخلاقی بالایی را برای اطمینان از انطباق و حفظ اعتماد عمومی رعایت کنند</span></span></span><span style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;Arial&quot;,sans-serif">. </span></span></span><span dir="RTL" lang="FA" style="font-size:11.0pt"><span style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">ترویج فرهنگ صداقت برای پیشگیری و رسیدگی موثر به جرایم یقه سفید ضروری است. در نظام جمهوری اسلامی قوانینی برای مبارزه با فسادهای مالی تصویب شده&shy;اند ولی آنچه که عیان است، کافی نبودن این قوانین است. بر اساس این قوانین نمی&shy;توان مجرمان یقه سفید را شناسایی و با آنان مبارزه کرد؛ حتی اگر این افراد شناسایی شوند، مجازات مناسبی در انتظار آنها نیست. برای مبارزه با مجرمان یقه سفید در ایران قانونی تحت عنوان چای دبش مطرح شده&shy;است که سعی شده است سیاستی ترسیم شود که بر نیمه پنهان حجم فسادهای مالی متمرکز باشد. این قانون علاوه بر اینکه راهکاری ارائه می&shy;دهد تا مجرمان یقه سفید شناسایی شوند، مجازات مناسبی نیز برای آنان پیش&shy;بینی کرده&shy; است.</span></span></span></div> <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span style="font-size:10.0pt">Background: </span></b><span style="font-size:10.0pt">In recent years, incidents based on corruption and embezzlement such as what happened in Debesh Tea Company have further weakened the country&#39;s economic body. The occurrence of such financial corruption disrupts the psychological security of society; something that is not given much attention. The people who cause such financial corruption with a very large amount of money in society are definitely not ordinary people in society and are white-collar criminals. In the present study, the fight against white-collar criminals in Iran is examined and ethical considerations are raised in this regard.</span></span></span></span></span><br> <b><span style="font-size:10.0pt"><span style="line-height:90%"><span style="font-family:&quot;Times New Roman&quot;,serif">Conclusion</span></span></span></b><span style="font-size:10.0pt"><span style="line-height:90%"><span style="font-family:&quot;Times New Roman&quot;,serif">: In general, the financial crimes committed by white-collar criminals in Iran can be compared to an iceberg floating in the ocean, only a part of which is visible and a large part of which is hidden. Ethical considerations are essential for addressing white-collar crimes. Organizations and legal professionals must adhere to high ethical standards to ensure compliance and maintain public trust. Promoting a culture of honesty is essential for preventing and effectively addressing white-collar crimes. The Islamic Republic has enacted laws to combat financial corruption, but what is clear is that these laws are insufficient. Based on these laws, white-collar criminals cannot be identified and fought against; even if these individuals are identified, they are not subject to appropriate punishment. A law called Chai Dabesh has been proposed to combat white-collar criminals in Iran, which attempts to outline a policy that focuses on the hidden half of the volume of financial corruption.
