fa عنوان: مبانی اخلاقی در اجرای احکام کیفری زنان از منظر فقه و حقوق ایران تخصصي Special مروری Review Article <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">زمینه: </span></span></b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">در فقه و حقوق ایران، همانگونه که بین جرم و جنسیت ارتباط وجود دارد، در اجرای مجازات نیز این رابطه دیده میشود. از این رو پژوهش حاضر با هدف بررسی مبانی اخلاقی ناظر بر اجرای مجازات‌ها برای زنان در قوانین ایران پرداخته و به ارائه احکام کیفری خاص زنان در ارتباط با تشهیر، تبعید، هم‌جنس‌گرایی، ارتداد، کیفیت اجرای حدّ، محل نگهداری محکومان و تاخیر در مجازات در شرایط خاص که با عنایت به مبانی اخلاقی وضع‌شده‌اند توجه نموده است. </span></span></span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:">نتیجه گیری:</span></span></b><span lang="AR-SA" style="line-height:90%"><span b="" mitra="" style="font-family:"> &nbsp;یکی از موضوعات مهم و مورد توجه جامعه بین المللی، احترام به حقوق زن و مرد و عدم تبعیض بر اساس جنسیت است. نتایج پژوهش حاکی از این است که در حقوق ایران سعی شده است اجرای مجازات برای زنان بر پایه دو مبنای نگاه کرامت &shy;محور به زن و رعایت عدالت صورت گیرد. برای رسیدن به این هدف در حوزه حقوق کیفری، حمایت هایی از حقوق زنان در قالب موارد ی چون: معافیت از تحمل دیه در جرایم خطای محض، تأخیر در اجرای مجازات، حمایت کیفری از زنان در صورت ترک نفقه و حمایت کیفری از زنان در باب ادای شهادت، صورت گرفته است. اما در رابطه با حقوق زنان خلاء های قانونی نیز در نظام عدالت کیفری ایران &nbsp;مشاهده می شود مانند: حقوق زنان در باب تناسب سن مسئولیت کیفری با واقعیت ، عدم وجود حمایتهای قانونی لازم در باب خشونت های خانگی اعمال شونده بر زنان و خلا های قانونی در قوانین شکلی</span></span><span dir="LTR" style="line-height:90%"><span arial="" style="font-family:">.</span></span><span lang="AR-SA" style="line-height:90%"><span style="font-family:"B Mitra""></span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt">Background: </span></b><span style="font-size:10.0pt">In Iranian jurisprudence and law, as there is a relationship between crime and gender, this relationship can also be seen in the implementation of punishment. Therefore, the present research aims to examine the moral foundations of the execution of punishments for women in Iranian laws and to present specific criminal sentences for women in connection with publicity, exile, homosexuality, apostasy, the quality of the execution of the limit, the place of detention of convicts and the delay in punishment in He has paid attention to the special conditions that have been established with regard to ethical principles.</span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span new="" roman="" style="font-family:" times=""><b><span style="font-size:10.0pt">Conclusion</span></b><span style="font-size:10.0pt">: One of the important issues and attention of the international community is respect for the rights of men and women and non-discrimination based on gender. The results of the research indicate that in Iranian law, punishment for women has been tried based on the two principles of looking at women&#39;s dignity and observing justice. In order to achieve this goal in the field of criminal law, protections for women&#39;s rights in the form of cases such as: exemption from paying dowry in cases of pure wrongdoing, delay in the execution of punishment, criminal protection for women in case of alimony and criminal protection for women in Testimony has taken place.
