other دادرسی اقتصادی در ترازوی اصول اخلاقی و عادلانه تخصصي Special پژوهشي Research <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span lang="AR-SA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">زمینه: </span></span></b><span lang="FA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">در جهت برخورد قاطع با مجرمین اقتصادی، تشکیل دادگاه‌های ویژه اقتصادی در سال 1397 مورد موافقت واقع و ساز و کاری جدید در فرآیند رسیدگی به جرائم اقتصادی به وجود آمد . در بدو تشکیل این دادگاه‌ها پرونده‌های کثیری به محاکم ویژه اقتصادی ارجاع و رسیدگی های فوری و برخورد قاطع در دستور کار قرار گرفت و احکام سنگین از جمله اعدام و حبس های بلند مدت در برخی از پرونده ها صادر و بلافاصله به مرحله اجرا در آمد . با توجه به شرایط خاص این دادگاهها برخی از اصول دادرسی عادلانه محدود شد. از آنجایی که لزوم پایبندی به اصول اخلاقی و عدالت در دادگاه های اقتصادی موضوعی مهم می باشد بهمین جهت هدف پژوهش حاضر بررسی دادرسی اقتصادی در ترازوی اصول اخلاقی و عادلانه بود. </span></span></span></span></span></span></span><br> <span style="font-size:11pt"><span style="line-height:90%"><span style="direction:rtl"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span lang="FA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;">نتیجه گیری:</span></span></b><span lang="FA" style="line-height:90%"><span style="font-family:&quot;B Mitra&quot;"> هر چند موافقت با استجازه اقتصادی منوط &nbsp;به عادلانه بودن دادرسی شده اما داده ها حکایت از تحدید اصول اخلاقی و عدالت در پاره‌ای از موارد در رسیدگی های اقتصادی دارد و &nbsp;ظن غیر منصفانه بودن برخی از رسیدگی های اقتصادی در افکار عمومی جامعه خصوصا فضای کسب و کار ایجاد شده است که وضع قوانین کارآمد و منطبق با معیارهای اخلاقی پیشنهاد می گردد. </span></span></span></span></span></span></span></div> <div style="text-align: justify;"><span style="font-size:11pt"><span style="line-height:normal"><span style="unicode-bidi:embed"><span style="font-family:&quot;Times New Roman&quot;,serif"><b><span style="font-size:12.0pt">Background: </span></b><span style="font-size:12.0pt">In order to decisively deal with economic criminals, the establishment of special economic courts in 2017 was approved by the fact that a new mechanism was created in the process of dealing with economic crimes. At the beginning of the establishment of these courts, many cases were referred to the special economic courts and urgent proceedings and decisive action were put on the agenda, and heavy sentences including execution and long-term imprisonment were issued in some cases and immediately implemented. According to the special conditions of these courts, some of the principles of fair proceedings were limited.
