fa مبانی اخلاقی استثنائات قوه قاهره از تأثیر بر تعهدات در دورۀ بیماریهای فراگیر Ethical Foundations of the Exceptions of the Cairo Authority from Affecting the Obligations in the Period of Widespread Diseases تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: قوه قاهره به حادثه ای غیرقابل پیش بینی، کنترل ناشدنی و خارج از قدرت شخص اطلاق می شود که انجام آن قابل انتساب به شخص مورد نظر نیست.  از لحاظ اخلاقی نیز شرط لازم برای مسئولیت پذیری عواقب یک موضوع انجام ارادی و اختیاری فعل است. به همین دلیل قوه قاهره اجرای عقد یا قرارداد را ناممکن یا دشوار می سازد. با پدید آمدن امور متحدثه مانند بیماریهای فراگیر نظیر آنچه در پاندمی کرونا پدید آمد بحث قوه قاهره و استثنائاتی که بر تعهدات وارد می آورد به حوزه اخلاقی نیز تسری پیدا کرد. از این رو مطالعه حاضر به بررسی مبانی اخلاقی استثنائات قوه قاهره از تأثیر بر تعهدات در دوره بیماریهای فراگیر پرداخته است. نتیجه گیری: استثنائات قوه قاهره در شرایط پاندمی متفاوت با استثنائات آن در معامله فضولی، مال مسروقه، مأخوذ بالسوم است. در بحث استثنائات قوه قاهره در شرایط پاندمی می توان بر اساس مبانی اخلاقی تقصیر و انجام ارادی و اختیاری فعل به این استثنائات دست یافت. بر طبق مبانی اخلاقی استثنائاتی بر قوه قاهره بر تعهدات در دوره همه گیری بیماریها جاری می شود که مهمترین آنها بحث اهمال و فریبکاری و سپس اراده اخلاقی برای انجام تعهد و صداقت به انجام تعهد پس از دوره همه گیری است.</div> <div style="text-align: justify;">Background: Force majeure refers to an unforeseeable, uncontrollable, and out-of-control incident that cannot be attributed to the intended person. From an ethical point of view, a necessary condition for being responsible for the consequences of a subject is the voluntary performance of the act. For this reason, the authority of Cairo makes it impossible or difficult to execute a contract. With the emergence of topical issues such as widespread diseases such as what emerged in the Corona pandemic, the discussion of the power of Cairo and the exceptions it imposes on obligations has also spread to the moral field. Therefore, the present study has investigated the ethical bases of the exceptions of the Cairo Authority from affecting obligations during the period of widespread diseases. Conclusion: The exceptions of Cairo's authority in pandemic conditions are different from its exceptions in snooping transactions, stolen property, derived from Balsam. In the discussion of the exceptions of Cairo's authority in pandemic conditions, these exceptions can be achieved based on the moral principles of guilt and voluntary and optional performance of the act.
