other جایگاه اخلاق حقوقی و نقش آن در کاستن از آسیب های اخلاقی قضات The Position of Legal Ethics and Its Role in Reducing the Moral Damage of Judges تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: در هر شغل و حرفهای پیروی از هنجارهای اخلاقی، یک ضرورت است. اما در تمام مشاغل این احتمال وجود دارد که صاحبان حرف با عدول از هنجارهای اخلاقی، کار خود را به نحو نادرست انجام دهند. در این میان برخی از مشاغل حقوقی از نظر امکان دچارشدن به آسیبهای اخلاقی، در زمره مشاغل پرخطر قرار می گیرند. یکی از این گروهها قضات هستند. این مساله ضرورت مراقبت و مواظبت اخلاقی  بیشتر برای دارندگان چنین مشاغلی ، جهت در امان ماندن از خطر انحرافات اخلاقی، را اجتناب ناپذیر می سازد. برای نیل به این هدف مقدس، در این مقاله به نقش اخلاق حقوقی در تعیین ضرورتهای اخلاقی ویژه قضات جهت کاهش آسیبهای اخلاقی این شغل پرداخته شدهاست. نتیجهگیری: شغل قضاوت به این دلیل که قاضی تعیین کننده تکلیف اختلافات میباشد و برای اعمال حق، ممکن  است تحت تاثیر عوامل گوناگون و افراد ذی نفوذ، از مسیر بی طرفی خارج شده یا با پذیرفتن هدیه، و امتیازات غیر متعارف و توصیه پذیری  موجب ضایع شدن حق بی گناهی شود، از مشاغل پرخطر از لحاظ اخلاقی محسوب میشود. قاضی در زمان صدور رای میتواند تحت تاثیر اهرمهای فشار به صورت مستقیم یا غیر مستقیم مانند رسانهها، شرایط اجتماعی و حتی فساد مالی و اخلاقی قرار گیرد. از این رو ضروریست چنین افرادی به صلاحیت های اخلاقی لازم مجهز باشند تا به اهداف عالی این شغل از جمله ایجاد قسط و عدل در جامعه، رضایت افراد جامعه و اعتماد مردم به دستگاه قضاوت اسلامی منجر شود.  </div> <div style="text-align: justify;">Background: In every job and profession, following ethical norms is a necessity. But in all professions, there is a possibility that the owners of words will do their work in a wrong way by deviating from the ethical norms. Meanwhile, some legal professions are among high-risk professions in terms of the possibility of moral harm. One of these groups are judges. This issue makes the need for more moral care and attention for the owners of such jobs, in order to avoid the risk of moral deviations inevitable. In order to achieve this holy goal, in this article, the role of legal ethics in determining the special moral needs of judges has been discussed in order to reduce the moral damage of this job. Conclusion: The job of judging is because the judge determines the task of disputes and in order to exercise the right, it may be influenced by various factors and influential people, he may deviate from the path of neutrality or by accepting gifts and unconventional and advisable privileges. To cause the loss of the right to innocence is considered a risky job in moral terms. At the time of issuing a verdict, the judge can be influenced by pressure levers directly or indirectly, such as the media, social conditions, and even financial and moral corruption.
