other معیارهای تجویز توسل به زور در صورت نقض فاحش و گسترده بنیان های اخلاقی حقوق بشری Criteria for Prescribing Coercion in case of Gross and Widespread Violation of the Ethical Foundations of Human Rights تخصصي Special پژوهشي Research <div style="text-align: justify;">زمینه: رعایت موازین حقوق بشر و پایبندی به اصول و بنیادهای اخلاقی آن از آسیب پذیری حاکمیتها در مقابل تصمیمات خارجی جلوگیری می کند و استقلال کشورها را در جهانی که وابستگی متقابل یکی از ویژگیهای آن است تضمین مینماید. دولتها، ضمن داشتن مشروعیت قانونی باید از مشروعیت اخلاقی نیز بهره مند باشند. در غیر این صورت، بهواسطه اظهارنظرهای نهادهای رسمی حقوق بشری سازمانهای بین المللی و دولتهای دیگر، با فشار افکار عمومی بین المللی مواجه میشوند. این فشار حتی می تواند تا حد توسل به زور برای وادار ساختن یک دولت نقض کننده حقوق بشر به رعایت مقررات مربوط و موازین اخلاقی، پیش رود. امروزه حقوق بین الملل تهدید و کاربرد زور در روابط بین المللی را ممنوع دانسته و از کشورهای عضو سازمانمللمتحد میخواهد از تهدید و کاربرد زور علیه استقلال سیاسی و تمامیت ارضی دیگر کشورها خودداری نمایند. لذا، هدف این مقاله بررسی معیارهای تجویز توسل به زور در صورت نقض فاحش و گسترده حقوق بشر و بنیادهای اخلاقی آن است. نتیجه گیری: بررسی منابع موجود نشان میدهد، تجویز توسل به زور در صورت نقض فاحش و گسترده حقوق بشر می تواند از مستندات و مقررات حقوق بین الملل عمومی تبعیت نماید. عدم رعایت بنیانهای اخلاقی حقوق بشری به گونه ای که وجدان جامعه بشری را جریحه دار نماید منجر به نقض فاحش حقوق بشر می گردد. و این امر می تواند مجوزی برای توسل به زور باشد. علاوه بر این محافظت از معیارهای اخلاقی مانند حمایت از حرمت انسانی، دفاع مشروع و حفظ صلح و امنیت بین المللی می تواند دلیلی برای توسل به زور در نظر گرفته شود و در چنین شرایطی تنها، شورای امنیت می تواند جواز توسل به زور را صادر نماید.  </div> <div style="text-align: justify;">Background: Observance of human rights standards and adherence to ethical principles and foundations prevents the vulnerability of governments to foreign decisions and guarantees the independence of countries in a world where interdependence is one of its characteristics. Governments, while having legal legitimacy, must also enjoy moral legitimacy. Otherwise, international organizations and other governments are under pressure from the international community due to the statements of official human rights organizations. This pressure can even go so far as to force a human rights abuser to comply with the relevant rules and ethics. Today, international law prohibits threats and the use of force in international relations, and calls on member states of the United Nations to refrain from threatening and using force against political independence and territorial integrity of other countries. Therefore, the purpose of this article is to examine the criteria for prescribing the use of force in the event of a gross and widespread violation of human rights and its moral foundations. Conclusion: A review of available sources shows that the imposition of coercion in case of gross and widespread violations of human rights can comply with the documents and regulations of public international law. Failure to uphold the moral foundations of human rights in a way that hurts the conscience of human society will lead to gross violations of human rights. And that could be a license to use force.
